Terms of Service

Kult Cards is a digital loyalty platform that lets businesses create reward cards (stamps, points, cashback, discounts, memberships, coupons, multipasses and gift cards) which their customers add to Apple Wallet or Google Wallet, and scan in-store to earn and redeem rewards.

The Service is provided on a self-service basis: you set up, configure and manage your loyalty programs yourself through the web application. We do not provide design, marketing, consulting or other professional services as part of a subscription; assistance we provide by email is standard customer support for using the software.

We may add, change or remove features at any time. We will give reasonable notice of material changes that adversely affect paid features.

You must be at least 18 years old and able to enter into a binding contract to use the Service. The Service is intended for businesses and their authorized staff, not for personal or household use.

You are responsible for the accuracy of your account information, for all activity under your account, and for keeping your login (including one-time codes) secure. Notify us immediately of any unauthorized use.

Paid plans are billed in advance, on a monthly or annual cycle, at the price shown at checkout. Prices are charged in euro (EUR); customers in North Macedonia are charged in Macedonian denar (MKD). Plans differ in the number of locations, active programs and team members included.

GMD Holdings LLC is the Merchant of Record for your purchase and handles invoicing, applicable taxes, order-related inquiries and refunds. Payments are processed through our payment provider.

New accounts may start with a 14-day free trial, available on the Starter monthly plan. You are not charged during the trial. If you do not cancel before the trial ends, your selected plan begins and your payment method is charged.

Subscriptions renew automatically each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current paid period. Every subscription payment is covered by the 30-day money-back guarantee in our Refund Policy.

We may change prices on renewal with at least 30 days’ notice.

You agree not to misuse the Service, including: using it for unlawful purposes; sending spam or unsolicited messages; uploading content that is illegal, infringing, deceptive or harmful; attempting to gain unauthorized access; reverse engineering or disrupting the Service; or using it to issue rewards you do not intend to honour.

You are solely responsible for the loyalty programs, rewards, offers and messages you create, and for honouring them with your customers.

When your customers join your loyalty programs, you are the controller of their personal data and GMD Holdings LLC acts as your processor. You are responsible for having a lawful basis to collect and use that data and for providing your customers with any required notices and consents.

You must only collect customer data through the Service for legitimate loyalty purposes and in compliance with applicable data-protection law.

The Service, including its software, design and branding, is owned by GMD Holdings LLC and protected by law. "Kult Cards" is a trade name of GMD Holdings LLC. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

You retain ownership of your content (logos, card designs, program details). You grant us a licence to host and display that content solely to provide the Service.

The Service relies on third parties including Apple Wallet, Google Wallet, our payment providers and hosting providers. Your use of those services is subject to their terms, and we are not responsible for them.

We aim to keep the Service available and reliable but do not guarantee uninterrupted operation. We may suspend the Service for maintenance, security or legal reasons.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others.

On termination, your right to use the Service ends. We may delete your data after a reasonable period in line with our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.

To the maximum extent permitted by law, the total liability of GMD Holdings LLC for any claim arising out of the Service is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, or for lost profits, revenue or data.

We may update these Terms from time to time. We will post the updated version with a new "last updated" date and, for material changes, give reasonable notice. Continued use after changes take effect means you accept them.

These Terms are governed by the laws of the Republic of North Macedonia, and disputes are subject to the exclusive jurisdiction of its competent courts, unless mandatory law provides otherwise.
